In a narrow 5-4 decision, the Supreme Court today upheld the constitutionality of Arizona’s school tuition organization law. The Arizona law, very similar to Georgia’s, provides a dollar-for-dollar credit against state tax liabilities for limited individual and corporate contributions to school tuition organizations, which in turn provide scholarships to students attending private (religious or non-religious, depending upon the STO, or, in Georgia, SSO) schools. This decision reverses the oft-reversed 9th Circuit Court of Appeals, closes the books on more than a decade of litigation in Arizona, and assures supporters of this version of school choice will be immune from constitutional challenge for the foreseeable future.
